Terms of service

These terms apply to the paid Recertia service for business customers. The English version is binding.

1. Parties and scope

The service is provided by Destina Sławińska Growify, ul. Grunwaldzka 23, 65-328 Zielona Góra, Poland, VAT PL9291789361 (the "Operator"), to customers acting in the course of their business (the "Customer"). The service is not offered to consumers.

2. The service

The Operator provides data about management system certificates published by companies: company name, website, standard, certification body, validity date and a link to the source document, delivered as a file (CSV or XLSX) or through an API, according to the order. Recertia is a private service, not an official register. The data is collected and checked with due care, but the Operator does not guarantee that it is complete or free of errors; the only authoritative confirmation of a certificate is the certification body that issued it.

3. Use of the data

The Customer receives a non-exclusive, non-transferable licence to use the data for its own business purposes for the term of the subscription. The Customer may not resell, sublicense, publish or share the data with third parties, or use it to build a competing product.

4. No marketing consents

The data is not a database of marketing consents. Before contacting any company for marketing purposes, in particular by e-mail, telephone or automated means, the Customer is solely responsible for complying with the law that applies to the recipient, including national rules implementing Directive 2002/58/EC and, where applicable, the GDPR. The Customer indemnifies the Operator against claims arising from its own contacts.

5. Corrections

Companies may ask the Operator to correct or remove their records; the Operator acts within 72 hours. The Customer applies corrections and removals delivered by the Operator within 7 days.

6. Price and payment

Prices and the scope are set out in the order form or offer. Invoices are payable within 14 days. For customers in other EU countries the reverse-charge mechanism applies.

7. Term and termination

Subscriptions run monthly unless the order says otherwise and may be terminated by either party with one month's notice to the end of a calendar month. Either party may terminate immediately for material breach not remedied within 14 days of notice.

8. Liability

The Operator is not liable for indirect damage, lost profit or decisions taken on the basis of the data. The Operator's total liability is limited to the fees paid by the Customer in the three months before the event giving rise to the claim. Nothing limits liability that cannot be limited by law.

9. Intellectual property

The Operator retains all rights to the database, including the sui generis database right.

10. Personal data

The data set contains no personal data. Personal data exchanged in the course of the contract is processed under the privacy policy.

11. Law and disputes

These terms are governed by Polish law, excluding the UN Convention on Contracts for the International Sale of Goods. Disputes are resolved by the court competent for the Operator's seat.

12. Changes

The Operator may change these terms with 14 days' notice by e-mail; a Customer who does not accept a change may terminate before it takes effect.
